Legislative Update No. 3, January 26, 2018

Thank You!

The 2018 Local Government Day took place on Wednesday, and we are grateful to everyone who participated. Our numbers were up—particularly among legislators—and we repeatedly received thanks and compliments for the event. We need that type of engagement if we are going to continue building a partnership between the state, county, and cities. Our success in the statehouse is not possible without your help, and we want to thank you again for your time, energy, and expertise. Each of us at KAC looks forward to seeing you all again soon!

New Governor in Waiting

The United States Senate confirmed Governor Brownback as the next Ambassador for International Religious Freedom. Governor Brownback will resign as governor on Wednesday, January 31, and Lieutenant Governor Jeff Colyer will then take the oath of office. You can read a brief biography of Lt. Governor Colyer at this link. Everyone is curious how he will approach leadership with so many significant issues looming in the Legislature. We look forward to working with the new administration on local issues.

Asset Forfeiture

Many of you may remember the report from Legislative Post Audit that evaluated asset forfeiture in Kansas. It spurred action by the Judicial Council to propose changes in our current laws. KAC’s General Counsel, Melissa Wangemann, served on the committee that published this report in December.

The response was House Bill 2459, which had hearings this week. The bill is a compromise each of the participants are supporting. There are still hurdles before passage, but the changes still appear to be on track. We will provide updates as the bill proceeds.

Election Commissioners

Election Commissioners are appointed by the Kansas Secretary of State in the four large urban counties. Two bills have been introduced to place the Election Commissioner under the county budget authority and personnel policies; SB 299 and HB 2506. The bills were necessary following Attorney General Opinion 2017-11 that issued this last fall, which said the Election Commissioner submits his/her budget to the Board of County Commissioners and the BOCC must approve the budget as requested. We are awaiting hearings on the two bills.
